O presente artigo analisa as teorias jurídicas da arbitragem internacional atualmente aceitas, pormenorizando os obstáculos ou contradições que delas emergem. Ao mesmo tempo, propõe-se uma nova teoria jurídica denominada détachement da arbitragem internacional, a qual é construída a partir de uma fusão de ideias expressas nas obras Aspects philosophiques du droit de l’arbitrage international, de Emmanuel Gaillard, e The Idea of Arbitration, de Jan Paulsson. O objetivo final é precisar a posição da arbitragem internacional no sistema jurídico global e suas consequências no campo prático.
