The control system of arbitral awards: a pro-arbitration critique of Michael Reisman's "architecture of international commercial arbitration"

Abstract: The author provides a critical analysis of what Professor W. M. Reisman calls "architecture of international commercial arbitration", founded upon the New York Convention. According to Reisman, the first tier of control by State courts concerns primary (or venue) jurisdiction, while the second tier relates to secondary (or enforcement) jurisdiction by State courts. The author disagrees on Reisman's two-tier control conception, in light of the Convention, pointing out alternatives for resolving problems of control of arbitral awards.
