Abstract: The article corresponds to Professor Karl-Heinz Böckstiegel's Lalive Lecture, which was given in Geneva in 2012. The author provides an overview of the main differences between commercial and investment treaty arbitration, in light of various factors such as the relevant legal traditions, applicable law, methods for constitution of the arbitral tribunal, jurisdiction, confidentiality and transparency, and case management.
